Google claims producing Android source documentation would be ?too burdensome?

It has emerged today that Google is playing hard to get when it comes to producing parts of its Android source code documentation.

In the ongoing legal battle between Apple and Samsung, Apple complained over Google?s unwillingness to reveal parts of its Android source code documentation, arguing that Google is improperly withholding information. It emerged that the Magistrate Judge also ordered Google to disclose in the next two days what search terms it is using to find the requested documents, and reveal which employees the documents came from.

Google is now claiming that acquiring this information would be ?too burdensome?. In response, judge Paul S. Grewal stated:

The court cannot help but note the irony that Google, a pioneer in searching the Internet, is arguing that it would be unduly burdened by producing a list of how it searched its own files.

Apple claims that most of Samsung?s prosecution power actually stems from Google?s Android operating system, and it seems that Google might be guilty of some stalling tactics in this particular instance.

The attorney for one of the Benghazi whistleblowers told TheBlaze Radio that he has more people who want to come forward to testify.

Joseph diGenova, attorney for acting Deputy Assistant Secretary of State for Counterterrorism Mark Thompson, did not specify how many new witnesses there were, but said they had been "on the ground" and "in the fight" during the September assault that left four Americans dead. Thompson was one of three whistleblowers who went before the House Oversight Committee on Wednesday.

"We've been contacted by some people on the ground who were there, who were in the fight, who want to come forward but who fear if they do they will never get contract work with the agency again,"?diGenova told TheBlaze Radio host Jay Severin on Thursday.?"We are going to test the director of central intelligence's word [that those who testify will not be penalized]. If these people decide they want to come forward, the first thing we're going to do is go to the director's office and say here they are, how are you going to protect them?" (SCROLL for audio)

DiGenova suggested there are more hearings on Benghazi to come, saying lawmakers "crossed the Rubicon yesterday, there's no turning back" after Wednesday's congressional hearing.

New Revelations About Benghazi

More questions have been raised about security in Benghazi and the Obama administration's handling of the situation after multiple senior-level intelligence officials confirmed to TheBlaze that Libya was under an elevated threat warning effective Sept. 8, 2012 -- three days prior to the assault. The warning about a potential attack went out to all impacted embassies, personnel numbers were reduced and requests for additional security were made.

"Everyone in the intelligence community knew this attack was coming," one source said.

Additionally, a Sept. 10 conference call with senior intelligence officials discussed the warning and made sure diplomatic facilities in Tripoli and Benghazi were aware of the situation.

One source estimated that at least 1,000 intelligence and State Department employees knew of the warning.

UPDATE 2-Republicans pass bill to pay bondholders first if U.S. debt cap hit

WASHINGTON, May 9 (Reuters) - Republicans in the House of Representatives passed a bill on Thursday, over the threat of a White House veto, that would allow the government to borrow money to pay bondholders and retirees if Congress fails to reach a deal to raise the U.S. debt ceiling.

The legislation is not expected to move forward in the Democratic-controlled Senate, but what is essentially a tactical maneuver will allow the Republicans who control the House to argue they have done their best to avoid a potential credit default and repeat of 2011's debt limit fight.

'Financial markets ought to be confident that their Treasury bonds are safe, regardless of what political storms are raging in Washington,' said Republican Representative Tom McClintock of California.

The bill, which passed 221-207 with no Democratic support, would essentially raise the debt ceiling for only two payments: interest and principal on government bonds as well as Social Security retirement benefits. Other government bills would be paid by incoming revenue until there was no more cash remaining.

The White House said it would veto the bill and Democratic lawmakers called it the 'pay China first' legislation as the Asian country holds more than $1.2 trillion in U.S. government bonds and is America's largest foreign creditor.

A number of Republicans also opposed the bill and said it would allow the United States to incur more debt - the very problem Republicans say they want to solve.

'It is a debt limit increase, and I think many do not realize that,' said Kentucky Representative Thomas Massie, one of eight Republicans who voted against the bill. 'Instead of helping to bring the national debt under control, this bill will only make a bad problem worse.'

By the end of next week, the Obama administration will no longer be able to borrow money to fund government operations because Congress has only agreed to extend the government's borrowing authority until May 19.

This will force the U.S. Treasury to start using its limited accounting maneuvers to extend its borrowing power. Such measures are not permanent and analysts say they could be exhausted by October.

REPUBLICAN STRATEGY

House Republicans are looking for ways to deal with the debt limit while staying true to House Speaker John Boehner's rule that any debt limit increase be matched by budget cuts and program reforms.

Republicans have been trying to force the administration to slash government spending and change Medicare healthcare and Social Security benefits in return for an increase in the debt ceiling.

They still have time to broker a deal with the White House as the federal government is running a much smaller deficit so far this year. Also, government-controlled Fannie Mae, the biggest U.S. mortgage finance company, said on Thursday it would repay the U.S. Treasury nearly $60 billion, giving the government more revenue.

So far, no deficit reduction deal is in sight. Though some allies of chief Republican tax writer Dave Camp of Michigan have floated the idea of linking a debt-limit increase to a revamp of the income tax code and lower tax rates.

This would allow lawmakers to skirt the politically painful decisions related to the costs of Medicare and Social Security. However, it is unclear if mainstream party supporters, much less the conservative faction of the Republican Party, will go along with this.

'It wouldn't be enough,' said Kevin Brady, a Texas Republican, who noted that reform of the Social Security and Medicare benefits programs still would be required.

Camp has been working for more than a year to draft an overhaul of the entire tax code and has vowed repeatedly to move legislation out of his Ways and Means Committee this year.

House Republican are due to hold a meeting next week to discuss the various debt ceiling options.

Boston Marathon bombing suspect Tamerlan Tsarnaev has been buried in an undisclosed location outside the city of Worcester, police said Thursday after a frustrating week-long search for a community willing to take the body.

"As a result of our public appeal for help, a courageous and compassionate individual came forward to provide the assistance needed to properly bury the deceased," Worcester police said in a statement.

Sgt. Kerry Hazelhurst said the body was no longer in Worcester and is now entombed. Police did not specify where the body was taken.

Tsarnaev's body had been at the Graham Putnam & Mahoney Funeral Parlors. Director Peter Stefan had said he could not find a community willing to take the body, including Cambridge, where the family had lived for a decade. Tsarnaev's uncle, Ruslan Tsarni, had custody of the body.

Meanwhile, Tsarnaev's widow continues to face questions from federal authorities and has hired a criminal lawyer with experience defending terrorism cases.

Katherine Russell added New York lawyer Joshua Dratel to her legal team, her attorney Amato DeLuca said Wednesday. Dratel has represented a number of terrorism suspects in federal courts and military commissions, including Guantanamo Bay, Cuba, detainee David Hicks, who attended an al-Qaida-linked training camp in Afghanistan.

Dratel's "unique, specialized experience" will help ensure that Russell "can assist in the ongoing investigation in the most constructive way possible," DeLuca said in a statement.

He said Russell, who has not been charged with any crime, will continue to meet with investigators as "part of a series of meetings over many hours where she has answered questions."

Providence-based DeLuca and Miriam Weizenbaum have been representing Russell, who is from Rhode Island. They specialize in civil cases such as personal injury law.

An FBI spokeswoman wouldn't comment when asked Wednesday whether Russell is cooperating. DeLuca has said Russell had no reason to suspect her husband and his brother in the deadly April 15 bombing.

JPMorgan board unanimously backs Dimon as chairman, CEO: letter

NEW YORK (Reuters) - Two ranking JPMorgan Chase & Co directors issued a letter to shareholders on Friday arguing against recommendations by proxy advisory firms to split the duties of Chairman and CEO Jamie Dimon and vote against some directors.

The board is unanimous in its view that it is best for Dimon to hold both roles and the current governance structure "is working effectively," according to the letter signed by presiding director Lee Raymond and William Weldon, who is chairman of the corporate governance and nominating committee.

The letter warned that a vote against current directors or to split the CEO and chairman roles "could be disruptive to the company and is not in shareholders' best interests."

The letter is a direct response to reports in the past seven days from advisory firms Institutional Investors Services and Glass Lewis & Co. The firms concluded that investigations of the bank's $6.2 billion loss on the "London Whale" derivatives trades showed the board had failed in its oversight of JPMorgan executives.

The incident is cited in policy debates in Washington as evidence big banks need to be broken up or required to hold much more capital for the safety of the financial system.

Both advisory firms recommended JPMorgan shareholders vote against re-election of three board members who served on the board's risk policy committee when the losses occurred.

The advisory firms generally take the view that having a board chairman who is separate from the CEO in a company leads to better oversight. They said the London Whale episode showed that JPMorgan was no exception.

The board letter on Friday said the firms "and others have incorrectly and unfairly characterized management's mistakes as a failure by the risk policy committee."

The letter was issued ahead of the bank's annual meeting on May 21 when shareholders will vote on the board's recommendation that all 11 directors be re-elected for another year.

The ballot also includes a non-binding resolution proposed by some shareholders that calls on the board to have a chairman who is independent from the CEO.

The vote on splitting the roles has come to be seen as a referendum on Dimon, 57, who was widely praised for leading the bank profitably and safely through the financial crisis and then saw that reputation tarnished by the trading debacle.

The seven-page letter came one year to the day after the company announced it was losing billions of dollars on the trades. Dimon had previously dismissed news reports of possible losses as a "tempest in a teapot."

The letter said the advisory firms focused "too narrowly" on the losses and a broader view of the company's performance shows Dimon and all of the board members should be supported in the voting.

The company reported record earnings and scored well on measures of profitability, including 15 percent returns on tangible common equity, every year for the last three years, the letter said.

"We highlight the performance of the Company not to diminish the events of last year or the lessons learned from them, but to provide important context," the letter said.

The letter defended by name the three directors on the risk policy committee who ISS said should not be re-elected. It said the three directors--David Cote, who is also chairman and CEO of Honeywell International Inc, James Crown, who is president of private investment firm Henry Crown and Company, and Ellen Futter, who is president of the American Museum of Natural History--had worked diligently and have "accomplished backgrounds."

The letter said there was no reason that the trio should have seen that a trading strategy which had successfully hedged the bank's credit risk had turned into a losing bet.

The directors said it depends on the situation whether it is best to have one person or two as chief executive and chairman. They noted that the board had split the roles when Dimon first became CEO and when his predecessor, William Harrison, first became CEO under another chairman.

Chronic pain sufferers likely to have anxiety

May 8, 2013 ? Patients coping with chronic pain should also be evaluated for anxiety disorders, according to new research published in General Hospital Psychiatry.

"I think [health care] providers are more aware of the common occurrence of depression in patients with chronic pain, and there has been less of an emphasis on anxiety," said lead author Kurt Kroenke, M.D., professor of medicine at Indiana University in Indianapolis.

In the new study, researchers evaluated 250 primary care patients who were being treated at a Veterans Medical Center in the Midwest. All patients had moderate to severe chronic joint or back pain that had lasted at least 3 months despite trying pain medications.

The participants were screened for five common anxiety disorders: generalized anxiety, characterized by persistent worry; panic, or sudden, repeated attacks of fear; social anxiety, characterized by overwhelming anxiety in everyday social interactions; post-traumatic stress, or a repeated feeling of danger after a stressful event; and obsessive-compulsive disorder, characterized by repeated thoughts or rituals that interfere with daily life. They were also screened for health-related quality of life issues, such as fatigue, sleep habits, and work productivity.

The study found that 45 percent of the pain patients screened positive for at least one or more of the common anxiety disorders. And those who had an anxiety disorder also reported significantly worse pain and health-related quality of life than patients without a disorder.

"It is important to note that patients in our study screened positive for an anxiety disorder but not all would have a full-blown anxiety disorder if they had a diagnostic psychiatric interview," said Kroenke. "Some may just have anxiety symptoms and not all would warrant active treatment. However, probably at least 1 in 5 might have some type of anxiety disorder."

The researchers also found that it was common for the five different types of anxiety conditions to occur in combination with each other and with depression.

"Psychological comorbidities are common in patients with chronic low back pain and other studies have also shown a high prevalence of depression, anxiety and other psychological conditions," said pain expert Roger Chou, M.D., an assistant professor of medicine at Oregon Health & Science University.

Chou added that the guidelines on evaluating and managing lower back pain do recommend clinicians assess patients for psychological factors that may be contributing to a poorer prognosis and address them with appropriate treatments.

"Many patients benefit from cognitive behavioral therapy to help them in coping with the pain and related anxiety," Chou continued. "Just throwing pain medications at someone like this doesn't tend to be very effective since you're not dealing with an important driver of the pain."
